About RoofCheck.AI — Our Promise

RoofCheck.AI is an AI-powered consumer protection tool for solar and roof analyses. We are not a solar panel dealer. All analyses and reports are free for consumers — funded by our partner programme (see transparency notice below and § 10 para. 8).

We are continuously developing RoofCheck.AI to offer the best possible consumer protection. Through the ongoing expansion of direct connections to public institutions, authorities and recognised database providers — including EU PVGIS, Google Solar API and Eurostat — we strive to deliver the most accurate, consumer-oriented solar analyses in Europe. Our AI models are regularly validated against current market data. We do not guarantee absolute completeness, but we promise: We strive for the best possible data quality.

Transparency notice: RoofCheck.AI is funded through the referral of contacts to specialist contractors and insurance partners in our network, as well as through technical risk analysis services (B2B) for insurance companies. Referrals are made only with the express consent of the user. Our analyses and recommendations are algorithmically computed and not influenced by referral partnerships.

§ 1 Scope of Application

(1) These Terms and Conditions (hereinafter "T&C") shall apply to all contracts concluded between RoofCheck.AI (hereinafter "Provider") and the user (hereinafter "Customer") via the website roofcheck.ai.

(2) The T&C shall apply in the version valid at the time of the order.

§ 2 Description of Services

(1) The Provider operates a digital platform for the analysis of solar potential for roof surfaces and other surfaces.

(2) The analyses and reports provided serve informational purposes only and do not replace professional advice from qualified specialist contractors.

(3) The results are based on available satellite data and algorithms. No guarantee is given for their accuracy or completeness.

§ 3 Special Conditions for the "Contract Check"

(1) The "Contract Check" (Verification) service constitutes a technical and economic plausibility assessment based on the documents submitted by the Customer. No on-site inspection takes place.

(2) No legal advice: The Provider expressly does not carry out a legal review of contracts. The results do not constitute legal advice within the meaning of the Legal Services Act (RDG). For the legal review of contractual clauses, consultation with a solicitor is recommended.

(3) No guarantee: The Provider does not warrant the accuracy of information provided by third parties nor the actual occurrence of projected yields. The assessment is based on empirical values and current market prices at the time of the analysis.

§ 4 Contract Formation

(1) The presentation of services on the website does not constitute a legally binding offer, but rather a non-binding invitation to the Customer to order services.

(2) The contract is formed upon confirmation of the order by the Provider.

§ 5 Prices and Payment Terms

(1) RoofCheck.AI provides its analyses and reports free of charge as a matter of principle. As a small business pursuant to §19 UStG, no VAT is charged or shown.

(2) Where paid add-on services are offered, the prices are stated in the respective product descriptions.

(3) Payment is made via the offered payment methods (e.g. bank transfer). The invoice amount is due for immediate payment.

(4) The satisfaction promise applies exclusively within the statutory withdrawal period of 14 days from the conclusion of the contract. To exercise this right, an informal notification by email to support@roofcheck.ai is sufficient. The refund shall be processed within 14 working days via the original payment method.

§ 6 Right of Withdrawal

(1) Consumers have a right of withdrawal of fourteen days.

(2) To exercise the right of withdrawal, you must inform us of your decision by means of a clear statement (e.g. by email).

(3) The right of withdrawal shall expire prematurely for digital content if you expressly consent to us commencing performance of the contract before the withdrawal period has expired.

§ 7 Liability

(1) The Provider shall have unlimited liability for intentional misconduct and gross negligence as well as under the Product Liability Act (Produkthaftungsgesetz).

(2) In the case of slight negligence, the Provider shall only be liable for the breach of material contractual obligations (cardinal obligations), the fulfilment of which is essential for the proper performance of the contract.

(3) In such cases, liability shall be limited to the foreseeable, contractually typical damage.

§ 8 Data Protection

The processing of personal data is carried out in accordance with ourPrivacy Policy.

§ 9 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 10 Final Provisions

(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.

(3) For consumers, the statutory place of jurisdiction shall apply. If the Customer is a business, the place of jurisdiction shall be the registered office of the Provider.

§ 11 Protection Status Check and Consent to Data Processing

(1) RoofCheck.AI offers an AI-supported protection status check, in which the user's analysis data is assessed by the RoofCheck AI as well as partner companies in our network (GDPR-compliant solar specialist contractors and insurance partners) in order to uncover hidden risks. This check requires the express consent of the user (Art. 6(1)(a) GDPR).

(2) Upon consent, RoofCheck.AI transmits the user's contact details (name, email address and key analysis data such as location and roof area) to partner companies in our network — exclusively for the purpose of risk assessment and protection status checks.

(3) RoofCheck.AI is not a contracting party to agreements between the user and the partner companies. Any contracts are concluded exclusively and directly between the user and the respective provider. RoofCheck.AI accepts no liability for the content, prices or contractual terms of third parties.

(4) Consent is voluntary and may be revoked at any time with effect for the future — by email to support@roofcheck.ai. Revocation shall not affect the lawfulness of processing carried out prior to its receipt (Art. 7(3) GDPR).

(5) The use of all free analyses and reports from RoofCheck.AI is not contingent upon consent to the protection status check.

(6) The selection of partner companies is based on availability, regional proximity and professional suitability. No preferential referral for payment takes place.

(7) RoofCheck.AI is not an insurance intermediary or adviser within the meaning of §34d GewO. The analysis constitutes an AI-based technical assessment — not an actuarial valuation and not legal or financial advice. RoofCheck.AI does not broker insurance contracts and receives no brokerage commissions. Terms such as "Score", "Check" or "Radar" denote AI-generated assessments that do not replace professional advice.

(8) RoofCheck.AI is funded through a partner programme: solar specialist contractors and insurance partners in our network receive — with the express consent of the user — the user's contact details for the preparation of individual offers. RoofCheck.AI receives a referral fee for this service. This funding has no influence on the AI analysis results.

(9) RoofCheck.AI also provides technical risk analyses (risk scores, degradation forecasts, damage reports) as a B2B data service for insurance partners in our network. These data services are used exclusively for technical risk assessment and do not constitute insurance intermediation. Remuneration is charged as a service fee for the technical analysis, not as a brokerage commission.
